President-elect Donald Trump is taking legal action in support of Texas and Missouri’s efforts to block the Biden administration from selling off materials intended for the border wall. On Thursday, Trump filed an amicus brief, calling the administration’s actions “possibly criminal” and urging the court to halt the sale of border wall components immediately.

This legal challenge follows a motion filed by Texas and Missouri earlier this week in a district court in the Southern District of Texas. The two states are asking the court to review whether the Biden administration is in violation of a permanent injunction issued earlier this year. That injunction barred the administration from diverting funds designated for border wall construction for any other purpose. The sales of border wall materials, which have been ongoing since at least 2023, have sparked fierce opposition from Republicans, who view the actions as a blatant effort to undermine border security.

In his amicus brief, Trump argues that the Biden administration’s actions could be criminal. “If officials are deliberately selling off border-wall materials at a significant financial loss to obstruct Congress’s pro-wall policy and to sabotage President Trump’s border security agenda, such conduct likely constitutes a criminal act,” the brief states. The brief also calls for a thorough investigation into the government’s actions, suggesting that the sale of these materials could be part of a larger scheme to defraud the United States.

Despite the Pentagon’s assertion that the materials no longer belong to the federal government, Republicans remain outraged. They believe the auctions are part of a deliberate strategy to prevent the Trump administration from completing the border wall. Senator Bill Hagerty (R-Tenn.) has introduced legislation to halt the auctions, while Texas officials are working to acquire the materials. Texas Attorney General Ken Paxton has vowed to prevent the sale of border security materials, emphasizing that the Biden administration is actively obstructing efforts to secure the southern border.

Trump, alongside Paxton and other state leaders, is determined to ensure the materials are used for their intended purpose—securing the southern border. “What they’re doing is really an act of sabotage,” Trump said. “If we don’t get those materials, we’ll have to start from scratch, and that will cost taxpayers hundreds of millions of dollars.”

Texas officials have also expressed their commitment to securing the materials. Texas Land Commissioner Dawn Buckingham has offered to store any materials acquired by the Trump administration on state land. “I am not going to ever give up the fight to protect our open southern border and defend Texans from the dangers brought on by illegal immigration,” Buckingham declared.

As the Biden administration continues to push forward with its controversial policies, Republicans are standing firm in their commitment to securing the border and holding the administration accountable for its actions. The battle over the future of the border wall is far from over, and the coming legal challenges will play a pivotal role in determining how President Trump’s agenda will be advanced in the face of Biden’s obstruction.
