The bid by opponents of former President Trump to prevent his inclusion on the Republican presidential primary ballot in Massachusetts has been unsuccessful. The Massachusetts State Ballot Law Commission dismissed the challenge on Monday, asserting that it lacked jurisdiction over the matter, as reported by Boston 25 News.
Amy Carnevale, Chair of the Republican Party of Massachusetts, lauded the dismissal, describing the attempt as “ill-conceived” and expressing support for the decision to let actual voters determine the nominee. Carnevale emphasized the importance of upholding democracy and criticized the effort by what she referred to as “career plaintiff lawyers” for potentially undermining the democratic process.
Massachusetts joins over a dozen other states that have contested Trump’s eligibility for inclusion on election ballots, both in primary and general elections, following the events of the Capitol riot on January 6, 2021. The legal challenges are based on the 14th Amendment to the Constitution, which bars individuals from holding office if they have previously taken an oath to defend the Constitution and later “engaged in insurrection or rebellion” or provided “aid or comfort” to enemies.
In a similar vein, the Colorado Supreme Court ruled in December to disqualify Trump from appearing on the state’s 2024 ballots. Trump has appealed this decision to the U.S. Supreme Court, which will ultimately decide on the matter. Additionally, Trump has contested a ruling by Maine’s secretary of state that barred him from the state’s primary ballot. Maine’s Supreme Judicial Court has indicated that it will only consider the matter after the U.S. Supreme Court issues its decision in the related Colorado case.
