In a stunning victory for President Donald Trump, the U.S. Supreme Court ruled Thursday that the State Department can continue enforcing its biological-sex passport policy, rejecting lower court attempts to block it.

Court Backs Trump’s Right to Set Policy

Indicating a person’s biological sex on a passport is no more a violation of equal protection than listing their place of birth; in both instances, the government is simply recording factual information, not discriminating.

Justice Ketanji Brown Jackson, joined by Justices Elena Kagan and Sonia Sotomayor, blasted the majority’s decision as a “painful perversion,” accusing the Court of “selectively discarding principles.”
But constitutional scholars note that the Trump administration has broad authority in foreign affairs and document policy. Solicitor General D. John Sauer called the lower court rulings “untenable,” writing that “the President’s decision to rely on biological sex should not be the testing ground for novel social experiments.”
New Policy Restores Traditional Standards
Under the reinstated rule, passports will now reflect a traveler’s biological sex only — with male and female as the two available options. The “X” designation, introduced under previous liberal administrations, has been eliminated.
Critics at the ACLU and other activist groups claim the policy could “endanger” transgender and nonbinary travelers. But supporters argue that the change brings the U.S. back in line with global documentation standards and ensures the accuracy and integrity of official records.
ACLU Vows to Keep Fighting
The American Civil Liberties Union has promised to continue challenging the Trump administration’s policy, calling it unconstitutional.
However, this marks the third major victory for Trump at the Supreme Court since his return to office — following earlier rulings that allowed his administration to:
- Enforce limits on gender-based military recruitment, and
- Eliminate taxpayer-funded diversity programs that critics called wasteful and divisive.

Across social media, conservative commentators praised the decision as a “win for truth and biology.” Many say the Court’s ruling reflects a broader shift away from political correctness and back toward traditional American values.
