The order allows for 2.5 miles of new physical barrier near San Diego, cutting through years of environmental regulation delays and legal gridlock. Under President Trump’s Executive Order declaring a national border emergency, Noem’s waiver eliminates bureaucratic obstacles—including the National Environmental Policy Act (NEPA)—that have long stood in the way of securing our southern border.

“This waiver allows for the rapid deployment of physical barriers where they are needed most,” DHS stated. “It reinforces our commitment to law, order, and the security of the American people.”

More than two dozen federal regulations, including the Endangered Species Act and Clean Water Act, are also set to be waived under this action—allowing critical infrastructure to move forward without obstruction.

As expected, radical environmental groups are fuming. Earthjustice, a well-funded left-wing legal group, called the move dangerous to ecosystems and border communities.

“Waiving clean air and water protections will only cause further harm,” said spokesperson Cameron Walkup.
