President Trump pushes bold education reform despite activist judges and Democrat obstruction

The Trump administration is escalating its legal battle to eliminate the Department of Education, asking the Supreme Court to reverse a lower court ruling that blocks the plan. At the heart of this effort is a push to cut federal bureaucracy, reduce wasteful spending, and give parents more control over their children’s education.

According to the emergency filing, the lower court’s injunction “effectively appoints the district court to a Cabinet role,” stripping decision-making authority from the Executive Branch. The administration says the ruling wrongly prevents the President from making necessary staffing and budget reforms.


Judge Blocks Trump’s Executive Order to Abolish DOE

In March, President Trump signed an executive order to dismantle the Department of Education, declaring it a broken system that has failed American families. But in May, U.S. District Judge Myong Joun issued a ruling halting the move—blocking layoffs and ordering the reinstatement of terminated staff.

This week, a federal appeals court refused to lift that injunction.


Trump Officials: “Judges Don’t Run the Government”

DOE Deputy Assistant Secretary Madi Biedermann slammed the ruling, saying:

“President Trump and the Senate-confirmed Secretary of Education—not an unelected judge—have the constitutional authority to reorganize federal agencies. This ruling prioritizes entrenched bureaucrats over American students.”

Biedermann confirmed the administration is filing an emergency appeal to the Supreme Court.

President Trump has consistently called for shutting down the DOE and returning power to states and local communities. His nomination of Linda McMahon as Education Secretary came with one clear instruction: “Make the department so irrelevant, you put yourself out of a job.”

Nation’s Report Card: Grim Results After Decades of Spending

Recent data from the National Assessment of Educational Progress—often called the Nation’s Report Card—revealed that 7 out of 10 fourth-grade students are not proficient in reading. Even worse, scores haven’t improved meaningfully since 1992, despite billions in federal spending.

This is one of the core reasons behind Trump’s push to close the department: Washington is wasting money while our children fall behind.
