This policy adjustment opens up these exchanges to individuals who arrived in the United States as children without legal documentation but hold Deferred Action for Childhood Arrivals (DACA) status.

This long-anticipated change is expected to facilitate access to health insurance and federal subsidies for approximately 100,000 uninsured DACA beneficiaries. It also carries potential political implications, potentially mitigating criticisms from pro-immigration advocates as President Biden faces pressure to address the issue of record-high illegal immigration ahead of the November 5 election.

An administration official highlighted the significance of this development during a press call, emphasizing that the final rule marks a historic milestone by extending Affordable Care Act coverage to DACA recipients for the first time. The move aims to provide over 100,000 DACA recipients with access to quality, affordable healthcare, granting them a sense of security and opportunity that aligns with American ideals.

The DACA program originated in 2012 under President Barack Obama as a response to the failure of the DREAM Act in the Senate.
