On Sunday, a federal judge issued a temporary restraining order that prevents the Trump administration from transferring three Venezuelan immigrants currently detained in New Mexico to the Guantánamo Bay detention center. This decision comes as part of the president’s efforts to crack down on illegal immigration and remove those in the U.S. unlawfully.

The three men in question were allegedly detained based on false charges, including connections to the Tren de Aragua gang, a notorious criminal group. Their legal representatives argue that they fit the profile of individuals the administration has prioritized for detention at Guantánamo. In response, they filed a motion in a New Mexico federal court, requesting a temporary restraining order to block the transfer to the Cuban military base. The legal team emphasized that the uncertainty surrounding legal processes and access to counsel justified the restraining order.

Judge Kenneth J. Gonzales ruled in favor of the order, but this action is only temporary, with further hearings expected in the coming weeks. The case is being supported by the Center for Constitutional Rights, the American Civil Liberties Union of New Mexico, and the Las Americas Immigrant Advisory Center.

Homeland Security Secretary Kristi Noem and White House Press Secretary Karoline Leavitt both confirmed last week that detained illegal immigrants have been flown to Guantánamo as part of the administration’s enforcement efforts.
