Biden Sued For Giving Illegals What?

A group of Republican-led states is challenging the Biden administration’s recent decision to expand Obamacare coverage to certain illegal immigrants. The move comes just days before the 2024 presidential election, heightening the stakes of the debate on immigration and healthcare policy.

In May, a new regulation was introduced that would enable illegal immigrants who entered the country as children and are shielded from deportation under the Deferred Action for Childhood Arrivals (DACA) program to access health insurance through the Affordable Care Act (ACA). This rule is set to take effect in November and could potentially offer coverage to over 100,000 individuals who are currently uninsured.

Fifteen states, spearheaded by Kansas Attorney General Kris Kobach, are contesting the legality of this rule. They argue that it breaches federal statutes that prohibit benefits for illegal immigrants and deviates from the original provisions of the ACA, which was designed to limit eligibility to U.S. citizens or those “lawfully present” in the country.

“Illegal immigrants should not receive taxpayer-funded benefits,” Kobach asserted. “The Biden-Harris administration’s attempt to bypass federal law is unacceptable. That’s why I’m leading this multistate lawsuit to prevent this unlawful regulation from being implemented.”

The lawsuit includes AG’s from Alabama, Idaho, Iowa, Indiana, Montana, Missouri, Nebraska, New Hampshire, North Dakota, Ohio, South Dakota, South Carolina, Tennessee, and Virginia.

The Department of Health and Human Services (HHS) contends that the rule simply makes “technical modifications” to the definition of “lawfully present” to accommodate DACA recipients. This adjustment would allow them to apply for insurance through HealthCare.gov and state marketplaces.

President Biden has defended the policy, advocating for a pathway to citizenship for DACA recipients, whom he refers to as “Dreamers.” He has emphasized their contributions to the nation and underscored his commitment to integrating them fully into American society. “I am proud of the Dreamers and their impact on our country. That’s why I have directed the Department of Homeland Security to reinforce DACA and why we are now ensuring that DACA recipients have the same healthcare access as other Americans,” Biden stated.

Vice President Kamala Harris echoed this sentiment, urging Congress to pass comprehensive immigration reform to secure permanent protections for Dreamers. “While President Biden and I will continue to support DACA, it’s a temporary fix. Congress must act to provide lasting security for these individuals,” she said.
