Judge O’Hearn claimed that removing Ireland and Bade would damage their military careers, reputations, and access to healthcare, stating these harms could not be resolved with money alone.

“Thousands of transgender servicemembers have sacrificed… to ensure the very equal protection rights the Military Ban seeks to deny them,” she wrote in a decision critics say misrepresents the purpose of military service.
