Treasury Secretary Scott Bessent revealed Monday that even if the Court strikes down Trump’s use of emergency tariff powers under the International Emergency Economic Powers Act (IEEPA), the White House has multiple backup plans to keep foreign nations from exploiting American trade.

Bessent explained to Reuters that although the administration expects to prevail in court, President Trump has another option available — Section 338 of the 1930 Smoot-Hawley Tariff Act. That provision gives the president authority to impose tariffs as high as 50 percent on nations that engage in unfair treatment of American trade.

“We are not powerless,” Bessent said. “If fentanyl pouring across our border and killing Americans isn’t a national emergency, then what is?”

This legal strategy underscores Trump’s America First economic agenda, ensuring that foreign nations pay the price for unfair trade practices.


Trump Blasts Appeals Court for Weakening America

The remarks follow a 7-4 appeals court ruling that rejected the administration’s emergency tariff authority. Trump immediately pushed back, warning the decision could devastate America’s future.

Trump warned that if the ruling is upheld, it would “deal a fatal blow to the United States.” He went on to remind Americans, as Labor Day weekend began, that tariffs remain “the strongest weapon to protect our workers and to back the companies that proudly build MADE IN AMERICA products.”

The ruling is on hold until October 14, giving the administration time to appeal directly to the Supreme Court.
