President Donald Trump suffered a major courtroom setback Friday after a federal judge struck down his administration’s policy pausing immigrant visa issuance for people from 75 countries.
U.S. District Judge Jeannette Vargas ruled that the Trump administration’s sweeping visa policy violated federal law and exceeded the legal authority of Secretary of State Marco Rubio.
The decision delivers another setback to Trump’s efforts to tighten the U.S. immigration system as his administration seeks stronger restrictions aimed at protecting American taxpayers and limiting reliance on government assistance programs.
Federal Judge Strikes Down Trump Visa Policy
The Trump administration announced the immigrant visa pause in January as part of its broader effort to overhaul immigration policy and scrutinize applicants who officials believed could eventually rely on taxpayer-funded public benefits.
The restrictions applied to citizens of 75 countries, representing nearly 40 percent of the world’s nations. Countries affected by the policy included Afghanistan, Brazil, Egypt, Haiti, Iran, Russia and Somalia.
When announcing the move, the State Department said the administration wanted to make sure the generosity of American taxpayers was not being taken advantage of.
That argument, however, did not persuade the federal court.
Vargas, who was nominated to the bench by former President Joe Biden, determined in her 61-page ruling that the State Department policy conflicted with requirements established by Congress.
Judge Says Federal Immigration Law Requires Individual Reviews
A central issue in the case involved the Immigration and Nationality Act, the federal law governing major portions of America’s immigration system.
Vargas pointed to provisions restricting consular officers from making immigrant visa decisions solely on the basis of an applicant’s nationality.
Under federal law, according to the ruling, consular officers generally must evaluate applicants individually and determine whether each person is legally eligible for an immigrant visa.
The judge concluded that the Trump administration’s policy went too far because it instructed officials to refuse visas to certain applicants who could otherwise satisfy the legal requirements.
That distinction became a major factor in the court’s decision.
Court Rules Marco Rubio Exceeded His Authority
The judge also concluded that the visa restrictions interfered with authority Congress granted to individual consular officers.
According to Vargas, Secretary of State Marco Rubio could not use a broad policy to override the individualized decision-making process required under federal immigration law.
The court ultimately found that the administration’s approach exceeded Rubio’s statutory authority and violated the Administrative Procedure Act.
As a result, Vargas ordered the policy vacated.
The decision could have significant consequences for immigrants affected by the restrictions, although the wider legal and political fight over Trump’s immigration agenda is unlikely to end with a single court ruling.
Immigration Group Celebrates Court Victory
The National Immigration Law Center, which was among the organizations representing plaintiffs challenging the policy, welcomed the decision.
Joanna Cuevas Ingram, a senior staff attorney with the organization, argued that immigration law cannot be used as justification for discriminatory treatment.
The organization said it intends to continue pursuing relief for individuals and families affected by the administration’s visa restrictions.
The White House and Justice Department had not responded to requests for comment cited in the original report.
Trump Immigration Policies Continue Facing Court Challenges
Friday’s ruling comes after another federal judge ruled against a separate Trump administration immigration policy in June.
That case involved the government’s decision to stop processing certain immigration applications connected to 39 countries. The restrictions affected applications involving work permits, green cards and U.S. citizenship.
Taken together, the cases illustrate the growing legal struggle over President Trump’s attempts to reshape immigration policy through executive branch authority.
The administration has maintained that tougher immigration controls are necessary to protect national interests, enforce existing laws and reduce the possibility that American taxpayers will be required to support newcomers who become dependent on government benefits.
Immigration advocates and other opponents argue that the president and executive branch must operate within the specific limits established by Congress, regardless of the administration’s policy goals.
Immigration Battle Could Be Far From Over
The larger question now extends beyond this particular visa policy.
Trump has made tougher immigration enforcement a central part of his political agenda, while federal judges continue to examine whether individual administration policies fall within the authority provided by existing law.
That creates an important distinction for Americans following the debate: Friday’s ruling did not settle the broader political argument over immigration. Instead, the court focused on whether this particular method of restricting immigrant visas was permitted under federal law.
For conservatives concerned about border security, government spending and the financial burden placed on American taxpayers, the ruling could renew calls for Congress to pass clearer and stronger immigration legislation rather than leaving major policy changes vulnerable to courtroom challenges.
For opponents of Trump’s approach, the decision represents an important check on presidential power.
