Now, with Donald Trump emerging as a leading contender for the 2024 Republican nomination amid mounting legal challenges, two legal experts have suggested that Melania Trump should consider revisiting those terms once more.
According to Insider, an intriguing report from Page Six recently claimed that Melania Trump has indeed engaged in this process, allegedly renegotiating a new “postnup” agreement with her husband over the past year. However, Insider could not independently verify this report, as representatives for both Donald Trump and various associates of Melania Trump did not respond to their requests for comments.
It’s important to note that renegotiating a prenuptial agreement isn’t solely reserved for couples experiencing marital difficulties. Attorneys emphasize that reviewing such a legal agreement is also a common practice among individuals anticipating potential financial challenges.
Currently, Donald Trump is facing four criminal indictments and a civil action in Manhattan, which resulted in a judge ordering the revocation of the Trump Organization’s New York corporate charters. Bill Beslow, a prominent divorce lawyer in New York City who represented Marla Maples in her 1999 separation from Trump, suggests that Melania Trump might seek additional protections for herself and her son, although he cannot confirm specifics about the couple’s current prenuptial agreement. He emphasizes that safeguarding one’s interests in marital assets is essential, especially when facing uncertain financial situations.
Beslow also points out that Melania Trump might use her current leverage to her advantage. He mentions that she could be telling Donald Trump, “This is what you need to do if you want my support on the campaign trail or in the courtroom.” Conversely, there might be certain actions she refrains from taking in exchange for concessions from her husband, such as not writing a book.
Melania Trump has so far distanced herself from her husband’s 2024 presidential campaign, avoiding public appearances with him both on the campaign trail and in court. As Donald Trump’s legal challenges continue to accumulate, his legal expenses are also likely increasing, according to Neama Rahmani, president of West Coast Trial Lawyers. Rahmani suggests that Melania Trump might be taking steps to protect herself financially in light of potential developments.
However, Beslow cautions against assuming that a prenuptial agreement renegotiation necessarily signifies trouble in the Trump marriage. High-profile couples often revise their prenups for various reasons, including acts of generosity. Nevertheless, less honorable motives can also come into play, such as altering the agreement to shield marital assets from creditors.
Regardless of the outcome in 2024, Rahmani advises Melania Trump that renegotiating the agreement at this juncture is a wise move. This proactive approach could potentially secure financial resources from the marriage before any creditors have a chance to make claims, ensuring her financial stability in uncertain times.
